Scope
This Policy applies to 360fitness.es and the website's forms/contacts (including WhatsApp and web-initiated calls). Membership conditions are governed by the Membership Agreement signed at the center.

 

Data and origin

• Leads/inquiries: name, email, phone number, and messages you provide us.

• Partners: identification and contact information, payment details/IBAN for direct debits, and service-related data (e.g., metrics and progress if you choose to provide them).

• Web/ads: Browsing and campaign data only if you accept analytics or advertising cookies.
  We don't collect sensitive data on the website; any health data used to personalize training is processed separately, at the center, and with explicit consent.

 

Purposes and legal bases
a) Handling inquiries and pre-registrations (managing appointments, queries, tracking your request): pre-contractual measures and legitimate interest in serving you.
b) Partner management and direct debit payments: execution of the contract.
c) Service monitoring (physical progress, internal quality): contract execution; health data with explicit consent.
d) Own commercial communications:
– If you're already a customer, opt in (Article 21.2 of the LSSI) for similar services; unsubscribe at any time.
– If you contact us as a lead, we may contact you by email or WhatsApp to manage your request and offer you information about our services with your consent, which you can withdraw at any time.
e) Online analytics and advertising (e.g., Google/Meta) only with your consent to the corresponding cookies via the banner.
We do not make automated decisions with legal effects.

 

Conservation

• Billing/contract: 6 years (commercial/tax obligation).

• Membership and progress: for the duration of the relationship and, after termination, during the statutory limitation periods.

• Leads/web inquiries: up to 12 months from the last contact or sooner if you object or withdraw consent.

• Marketing: until you unsubscribe or withdraw consent.
  After each term, we block the data for the applicable responsibilities.

 

Recipients/managers
We do not share data except under legal obligation or to provide the service through third parties:

• Wix.com (site hosting).

• TIMP (member management).

• Notion (CRM) and Make.com (automation).

• WhatsApp Business/messaging providers to communicate with you.

• Google (Analytics/Ads) and Meta, only if you accept analytics/ads cookies.
  When there are international transfers (e.g., to the US), we apply Standard Contractual Clauses (SCCs) or other GDPR safeguards.

 

Rights
You can exercise access, rectification, deletion, objection, restriction, portability, and withdrawal of consent by writing to 360fitness.bcn@gmail.com. You can also file a complaint with the Spanish Data Protection Agency (AEPD).
Minors: This site is not intended for children under 14 years of age. Minors' employment at the center requires the consent of their legal guardian.

 

Security
We implement appropriate technical and organizational measures to protect your data from unauthorized access, loss, or alteration.
